General Provisions
A municipal state enterprise on the right of economic management “Pavlodar College of Technical Service” of the Education Department of Pavlodar region, akimat of Pavlodar region (hereinafter referred to as the Enterprise) is a legal entity in the legal form of state enterprise on the right of economic management. It was established for the implementation of technical and vocational education curricula, which are an integral part of the secondary education level, aimed at training skilled workers and mid-level specialists in the main areas of socially useful professional activity and applied baccalaureate.
The enterprise was reorganized by the resolution of the Akimat of Pavlodar region dated February 04, 2019 No. 23/1 “On the reorganization of legal entities in the field of education of the Pavlodar region” and renamed into the municipal state enterprise on the right of economic management “Pavlodar College of Technical Service” of the Education Department of Pavlodar region, akimat of Pavlodar area.

  1. The founder of the Enterprise is the local executive body – the Akimat of Pavlodar region (hereinafter – Akimat).

The rights of the subject of communal property in relation to the property of the Enterprise are exercised by the local executive body – the akimat of Pavlodar region.

  1. The body managing the Enterprise is the State Institution “Education Department of Pavlodar Region” (hereinafter referred to as the Management Body).

  1. Legal status of the Enterprise

An enterprise is considered created and acquires the rights of a legal entity from the moment of its state registration.
The company has an independent balance sheet, bank accounts in accordance with the legislation of the Republic of Kazakhstan, letterhead, seals with the State Emblem of the Republic of Kazakhstan and the name of the company.
An enterprise cannot create or act as a founder (participant) of another legal entity, with the exception of cases provided for by the legislation of the Republic of Kazakhstan.
An enterprise may establish branches and representative offices in accordance with the legislation of the Republic of Kazakhstan.

  1. Civil law transactions concluded with the Enterprise and subject to mandatory state or other registration in accordance with the legislative acts of the Republic of Kazakhstan are considered to be completed from the moment of registration, unless otherwise provided by legislative acts of the Republic of Kazakhstan.

The subject and objectives of the enterprise
The subject of the Enterprise is the implementation of educational curricula of technical, professional, post-secondary, applied baccalaureate, as well as additional education for students.

  1. The goal of the Enterprise is to create the necessary conditions for a quality education aimed at the formation, development and professional development of the individual on the basis of national, universal values, achievements of science and practice.

Training of qualified personnel in the mass specialties of technical and vocational education, in the main areas of socially useful professional activity, as well as applied undergraduate education from among citizens with secondary education (general secondary or technical and vocational).
Implementation of additional educational programs: the development of youthful creativity, inclinations, and interests in the field of sports, culture and art, IT-technologies, the sphere of services, advanced training of specialists).
To achieve this goal, the Company carries out the following activities:
1) the implementation of educational curricula of technical and vocational, post-secondary education and applied baccalaureate, by creating the necessary conditions aimed at the formation, development and professional formation of the personality;

2) ensuring the training of highly skilled workers and specialists competitively capable in the labor markets, retraining and advanced training;

3) interaction with employers and other social partners to improve the quality of training of qualified workers, specialists;

4) the implementation of industrial and economic activities in the field of education of the Pavlodar region;

5) implementation and effective use of new training technologies;

6) the receipt of income necessary for the maintenance and development of the Enterprise, through the execution of state orders, paid services and business contracts concluded with enterprises, organizations, joint-stock companies, partnerships, individual entrepreneurs and individuals;

7) the organization of the procurement and sale of goods, works and services in accordance with the legislation of the Republic of Kazakhstan on public procurement;

8) development of financial and economic activities, strengthening the material and technical base.

The company is not entitled to carry out activities, as well as to make transactions that do not meet the subject and goals of its activities, as enshrined in this Charter.
A transaction made by the Enterprise in contradiction with the objectives of its activity, which are specifically limited by the laws of the Republic of Kazakhstan and the constituent documents, or in violation of the statutory competence of the head, may be invalidated at the suit of the authorized body of the relevant industry (local executive body) or the authorized body for state property, or the prosecutor.
The actions of the head of the enterprise aimed at the implementation by the enterprise of unlawful activity are a violation of labor duties and entail the application of disciplinary measures.

  1. Educational curricula,

sold in the enterprise

The Company implements educational training programs for technical and vocational, post-secondary education, as well as applied undergraduate studies.

  1. The training programs implemented by the Company include:
    1) the training of personnel in the mass specialties of technical and vocational education, which provides for the study of integrated courses in general subjects, which is core for the successful development of general professional and special disciplines, the passage of industrial training for the acquisition of professional skills with assignment to students of the achieved level of professional qualification (rank, class, category ) for a specific specialty;

2) mastery of more complex (related) qualifications and practical skills in performing technical and service work in all sectors of the economy associated with high technologies and professional activities, providing for the study of general humanitarian, economic, general professional, special disciplines, industrial training and professional practice for acquisition and consolidation of professional skills with the assignment of an increased level of professional qualification for a specific second specialty;

3) the training of highly qualified technical labor specialists, their retraining and advanced training, providing for the study of integrated educational programs of technical and vocational education, first and second year programs of higher educational institutions with assignment to students of the achieved level of professional qualification (rank, class, category) in a particular specialty .

Upon completion of training and passing the final certification, students are assigned an increased level of professional qualification in a particular specialty.

Upon completion of the full training course and passing the final certification, students are assigned the qualification of a mid-level specialist.

Professional programs of post-secondary education implemented by the Company include, along with professional programs, the study of social-humanitarian and natural sciences, integrated with professional curricula of the first and second courses of higher education with assignment of applied undergraduate qualifications (according to the law on licensing educational institutions, teachers with academic degrees are required for this level degree).

  1. The organization of the educational process

The company provides full-time and other forms of training.
The enterprise, based on existing capabilities, in accordance with the requests of students independently determines the language of instruction, provides knowledge and development of the Kazakh language as the state language, the study of the Russian language and one of the foreign languages.
The enterprise independently organizes the educational process in the manner prescribed by the legislation of the Republic of Kazakhstan, in accordance with the work curricula and programs.
The accounting of educational and educational work in the Enterprise is carried out by conducting journals of accounting for theoretical and industrial training and statements of accounting for academic time in hours.
The content of educational curricula implemented in the enterprise by a specific profession, the timing of their development is determined by the working curricula and programs developed in accordance with the requirements of standard curricula and standard curricula.

intermediate and final certification of students, forms

and the procedure for their implementation in the Enterprise

In order to control the assimilation by students of educational curricula, the Company carries out ongoing monitoring of student performance, interim certification, and final certification.
The enterprise independently in choosing the forms, order and frequency of conducting ongoing monitoring of the performance of intermediate and final certification of students.

  1. The current performance monitoring, intermediate and final certification of students of the Enterprise are carried out in the manner approved by the central executive body in the field of education.

The following types of training are used in the enterprise: lesson, lecture, seminar, practical lesson, laboratory work, test, independent work, consultation, practice, course and diploma design (course and diploma work), comprehensive exam, real design. For all types of classroom lessons, a duration of 45 minutes is set, if necessary, paired lessons are allowed with breaks of 5 and 10 minutes after two lessons.
The quality of the knowledge and skills of the students of the Enterprise is evaluated in points: 5 (excellent), 4 (good), 3 (satisfactory), 2 (unsatisfactory). A direct check of the quality of knowledge, skills and abilities of students is carried out by oral questioning, completing laboratory and practical tasks, conducting frontal control and verification work, periodic checking of notebooks, abstracts, control work, and homework.
For the organization and conduct of training sessions with students in the company created training groups. In accordance with the curriculum, study groups can be divided into subgroups.
Types, terms and content of professional practice are determined by working curricula and working curricula.

The procedure for admission of students, graduation, deduction and provision of academic leave in the Enterprise
The Company accepts persons who have received basic secondary or general secondary education in accordance with the regulations for the provision of the public service “Documents Acceptance and Admission to Educational Organizations, which carry out staff training in educational programs of technical and vocational education”.
The transfer of students to another educational institution and their restoration for training at the Enterprise is carried out in the manner approved by the central executive body in the field of education.

  1. Students can be expelled from the Enterprise:

1) own desire;

2) the state of health on the basis of a certificate-conclusion of a medical advisory commission;

3) transfer to another educational institution;

4) academic failure and missing classes without good reason;

5) violation of academic discipline, internal regulations and requirements stipulated by this Charter;

6) violation of the terms of the contract for training;

7) in other cases provided for by the legislation of the Republic of Kazakhstan.

The provision of academic leave for students in the Enterprise is carried out in the manner approved by the central executive body in the field of education.
Graduates of the Company, studying in the curriculum of technical and vocational, post-secondary education and applied bachelor’s degree, who passed the final state certification, are issued state documents with an indication of the level of education and qualification.

41.With persons who have entered training, the Company enters into agreements, the standard form of which is approved by the central executive body in the field of education.

Work Rights and Obligations

Rights and obligations of employees of the Enterprise
Persons with special pedagogical or professional education are allowed to engage in pedagogical activities in the Company.

  1. The pedagogical worker of the Enterprise has the right to:

1) engaging in teaching activities with certain conditions;

2) the occupation of research, experimental work, the introduction of new techniques and technologies in teaching practice;

3) individual pedagogical activity;

4) a free choice of methods and forms of organization of the pedagogical process, subject to the requirements of state generally binding education standards;

5) participation in the work of collegial management bodies of the Enterprise;

6) continuing education at least once every five years;

7) early certification in order to upgrade the category;

8) moral and material incentives for successes in pedagogical activity (state awards, honorary titles, bonuses and scholarships);

9) protection of their professional honor and dignity;

10) appeal of orders and instructions of the enterprise management.

The pedagogical worker of the Enterprise is obliged:
1) possess relevant theoretical and practical knowledge and skills;

2) to ensure the quality of educational services provided in accordance with the requirements of standard curricula and standard curricula;

3) to educate students in the spirit of high morality, respect for parents, ethno-cultural values, respect for the world around;

4) to promote the development of life skills, independence, and creative abilities of students;

5) constantly improve their professional skills, intellectual, creative level;

6) to pass certification at least once every five years;

7) comply with the standards of pedagogical ethics;

8) respect the honor and dignity of students and their parents;

  1. Rights and Obligations of Studying Enterprises

and their parents (legal representatives)

  1. Learning Enterprises are entitled to:

1) obtaining a quality education in accordance with standard curricula and standard curricula;

2) training by decision of the pedagogical council of the Enterprise in the framework of standard curricula based on individual curricula, abridged educational curricula;

3) the choice of alternative courses in accordance with the curriculum;

4) obtaining additional educational services, knowledge according to their inclinations and needs for a fee;

5) restoration and transfer from one educational institution to another, from a paid basis to study at the state educational order or from one form of education to another;

6) free use of information resources in the Company, provision of textbooks, teaching and methodological complexes and manuals in the manner established by the Government of the Republic of Kazakhstan;

7) free use of the services of sports, reading, assembly halls, libraries;

9) free expression of one’s own opinion and belief;

10) respect for one’s human dignity;

11) encouraging and rewarding for successes in studies, scientific and creative activities;

  1. ​​Students are required to:

1) to acquire knowledge, skills, practical skills in accordance with the requirements of standard curricula and standard curricula, comply with the Internal Rules, comply with other requirements stipulated by this Charter;

2) take care of your health, strive for spiritual and physical self-improvement;

3) respect the honor and dignity of teachers and the traditions of the institution;

4) comply with the requirements for appearance imposed by the Company;

5) respect national, universal and spiritual values;

6) take care of the property of the Enterprise;

For violation of obligations, students may be subject to disciplinary measures provided for by the Internal Rules and this Charter, as well as other measures, in accordance with applicable law;

  1. Parents or other legal representatives of students of the Enterprise have the right:

1) participate in the work of the governing bodies of the Enterprise through the board of trustees;

2) receive information regarding the performance, behavior and learning conditions of their children.

  1. Parents or other legal representatives of students of the Enterprise are required to:

1) to create healthy and safe conditions for the life and studies of children, to ensure the development of their intellectual and physical abilities, moral formation;

2) comply with the rules defined by the Charter of the Enterprise;

3) to ensure that children attend classes at an educational institution;

4) respect the honor and dignity of the teaching staff of the Enterprise.

The procedure for the provision of paid services
An enterprise is entitled to provide the following types of goods (works and services) on a paid basis:
1) the organization and conduct of preparatory classes for applicants upon admission;

2) the development of test tasks to assess the level of professional training;

3) conducting trial testing to assess the level of training;

4) passing a second exam (testing) based on the results of intermediate or final certification of students;

5) re-issuance of student cards, grade books and pass tickets;

6) education and training of skilled workers, middle managers and applied baccalaureate (for students who are not studying by state order) with full cost recovery;

7) the organization of additional classes with individual students in subjects (disciplines and cycles of disciplines) in addition to the study time allocated according to the curriculum of programs;

8) the organization of in-depth study by students of the fundamentals of sciences in subjects (disciplines and cycles of disciplines);

9) the implementation of additional educational programs, the creation of centers (the development of youthful creativity, inclinations and interests in the field of education, sports, culture and art, catering and cooking services, in the field of services, technical creativity, information technology and programming, sewing production and clothing modeling, Workers and more);

10) the organization and conduct of various events: sports competitions, seminars, meetings, conferences, professional skill competitions, tournaments, sports and athletics competitions among students, teachers and adults;

11) printing and copying services, the development and implementation of educational and methodological literature, materials of scientific and practical conferences, including on electronic media, the release of conference collections;

12) catering for students, employees of the Company and the public;

13) the provision for use of musical instruments and additional Internet connection services, equipment;

14) the provision for use of classrooms, workshops, a gym, a sports hall and an assembly hall, sports grounds, a stadium, parking spaces for vehicles, a canteen, a buffet and rooms, as well as free of charge enterprises, social partners, legal entities and individuals, within prisoners agreements on cooperation, and at the time of meetings, negotiations, summits of other cultural events;

15) provision of a place in a hostel with payment of utilities for the duration of studies for students on a paid basis, for employees of the Enterprise for the period of work, according to the concluded individual labor contract;

16) the provision of accommodation services for participants in meetings, negotiations, various events and exchange participants within the framework of academic mobility, tourist groups, individuals and legal entities;

17) the organization of vocational training (retraining and advanced training of workers and specialists, adults and unemployed citizens);

18) organization of production and sales of products of training workshops, educational farms, training and experimental sites (confectionery and bakery products, catering and cooking services, technological creativity, tailoring, special clothing, modeling, printing and advertising products, manufacturing of metal products and wood and more);

19) the provision of paid services in the field of culture and art (theatrical productions, script writing, festive events, choreographic, directorial and vocal services, training in musical instruments);

20) the provision of IT services;

21) photo and video shooting, design development and production of invitation cards, welcome addresses, business cards;

22) transport services;

23) organization of summer vacations;

24) conducting short-term professional training with the issuance to persons who have passed the training, who have passed the qualification exam, certificates of the established form or certificate;

25) organization of training, retraining of specialists, workers in the field of industrial safety, labor protection.

Funds from the provision of paid activities are planned and used by the Company on its own.

The international cooperation
The company, in agreement with the central executive body in the field of education, in accordance with the specifics of its work, has the right to establish direct relations with foreign organizations of education, science and culture, international organizations and foundations, conclude bilateral and multilateral cooperation agreements, participate in international student exchange programs , join international non-governmental organizations (associations) in the field of education.
The procedure for international cooperation by educational organizations of the Republic of Kazakhstan is established by the central executive body in the region.
Enterprise Management
The local executive body performs the following functions:
1) makes decisions on the establishment, reorganization and liquidation of the Enterprise;

2) approves the Charter of the Enterprise, makes amendments and additions to it, or authorizes the executive body, financed from the local budget, authorized to manage communal property;

3) assigns communal property to the Enterprise;

4) agrees to the establishment of branches and representative offices by the Enterprise, as well as regional centers of distance learning technologies on the basis of the Enterprise;

5) makes decisions on the use of the property of the Enterprise, including on the transfer of it as a pledge, lease, gratuitous use and trust management;

6) exercises other powers assigned to it by this Charter and the legislation of the Republic of Kazakhstan.

  1. The governing body exercises the following powers:

1) develops acts on the management of the Enterprise, ensures their implementation;

2) make proposals in the established manner: on the establishment, reorganization and liquidation of the Enterprise; on the establishment of its branches and representative offices; on approval of the Charter of the Enterprise, introduction of amendments and additions to it;

3) determines the priority areas of activity and the required volumes of work (services) financed from the budget of the Company;

4) consider, coordinate and approve the development plans of the Enterprise and reports on their implementation, monitor and analyze the implementation of these plans;

5) makes proposals on securing communal property to the Enterprise;

6) makes a proposal to the executive body, financed from the local budget, authorized to dispose of the regional communal property to use the property of the Enterprise, including the transfer of it as a pledge, gratuitous use and trust management;

7) provides control over the use and safety of the property of the Company, organizes the accounting of property and ensures its effective use;

8) draws up labor relations with the head of the Enterprise by concluding an employment contract in accordance with the labor legislation of the Republic of Kazakhstan, carries out its certification in the manner determined by the Government of the Republic of Kazakhstan;

9) upon the recommendation of the head of the Enterprise, appoints and dismisses deputies (deputy) of the head, chief (senior) accountant;

10) exercises other powers assigned to it by this Charter and the legislation of the Republic of Kazakhstan.

Labor relations with the Head of the Enterprise are made out by concluding an employment contract in accordance with the Labor Code of the Republic of Kazakhstan.
In the employment contract, in addition to the conditions established by the Labor Code of the Republic of Kazakhstan, the liability of the head of the Enterprise for untimely transfers of the established part of net income to the budget is determined.
The appointment of the head, carrying out his certification is carried out in the manner determined by the Government of the Republic of Kazakhstan.
The Head of the Enterprise acts on the principles of independent decision of all issues of the Enterprise in accordance with its competence, determined by the legislation of the Republic of Kazakhstan and this Charter.
Collegial governing bodies may be created in the Company: guardian, pedagogical, parental, methodological councils and other forms. The procedure for the formation and activities of collegial bodies of the Enterprise, the delimitation of powers between them are determined by standard rules of activity approved by the authorized body in the field of education.
The Head of the Enterprise is personally responsible for:
1) the organization of anti-corruption in the enterprise;

2) violation of the rights and freedoms of students, employees of the Enterprise;

3) failure to perform functions assigned to its competence;

4) violation of the requirements of standard curricula and standard curricula;

5) life and health of students and employees of the Enterprise during the educational and educational process;

6) the state of financial and economic activity, including misuse of material and cash resources, the safety of property;

7) other violations of the legislation of the Republic of Kazakhstan, the employment contract;

  1. The Head of the Enterprise has the following powers:

1) to act on behalf of the Enterprise without a power of attorney and represent its interests in all bodies;

2) to the extent established by the legislation of the Republic of Kazakhstan, to dispose of the property of the Enterprise;

3) conclude contracts and make other transactions;

4) issue power of attorney;

5) open bank accounts;

6) issue orders and give instructions binding on all employees of the Enterprise;

7) in accordance with the labor legislation of the Republic of Kazakhstan, accept and terminate employment contracts with employees of the Enterprise, take incentive measures and impose penalties on them, in the manner established by the legislation of the Republic of Kazakhstan;

8) to present candidates to the Management Body for appointment and dismissal of their deputies (deputy) of the chief (senior) accountant and other senior employees of the Company;

9) establish the competence of its deputies and other senior employees of the Company;

10) approve the forms of remuneration, staffing, the size of official salaries, the bonus system and other remuneration of employees of the Company;

11) appoints and dismisses the directors of the branches and representative offices of the Enterprise in agreement with the Management Body;

12) approves the regulations on branches and representative offices of the Enterprise;

13) approves the procedure and plans of the Enterprise for business trips, internships, employee training in Kazakhstani and foreign training centers and other types of staff development.

14) carry out other functions assigned to it by the legislation of the Republic of Kazakhstan, this Charter and the authorized body of the relevant industry (local executive body);

The relationship between the Enterprise, the local executive body and the management body is governed by the current legislation of the Republic of Kazakhstan.
The procedure for the formation of property of the Enterprise

The assets of the Enterprise are its assets, the value of which is reflected in its balance sheet.
The property of the Company is indivisible and cannot be distributed among deposits (stakes in the authorized capital, shares), including among employees of the Company.

  1. The property of the Enterprise is formed due to:

1) property transferred to him by the local executive body;

2) property (including cash income) acquired as a result of its own activities;

3) other sources not prohibited by the legislation of the Republic of Kazakhstan.

The acquisition and termination of the right of economic management is carried out on the terms and in the manner prescribed by the civil code of the Republic of Kazakhstan for the acquisition and termination of property rights and other property rights, unless otherwise provided by this Charter or contrary to the nature of this property right.
The fruits, products, income from the use of property that is under economic management, as well as property acquired by the Company, under contracts or other grounds, are transferred to the economic management of the Company in the manner established by the legislation of the Republic of Kazakhstan for the acquisition of property rights.
The right of economic management of property, in respect of which the decision was made by the governing body to assign it to the Company, arises for the Company at the time of fixing the property on its balance sheet, unless otherwise provided by the legislation of the Republic of Kazakhstan.
The company does not have the right to alienate property on the basis of a contract of sale, exchange, gift of property related to its fixed assets allocated to it according to the estimate.
The right of economic management to the property of the Enterprise shall be terminated on the basis and in the manner prescribed by Article 249 of the Civil Code of the Republic of Kazakhstan for termination of the right of ownership, as well as in the case provided for in paragraph 73 of Chapter 14 of this Charter.
In addition to the general grounds for terminating the right of economic management provided for in paragraph 72 of Chapter 14 of this Charter, the right of economic management is terminated in cases of lawful seizure of property from the Enterprise by decision of the owner.
Cases of lawful seizure of property include, but are not limited to:

  • seizure of property that does not meet the objectives of the authorized activities of the Enterprise on the basis of economic management;
  • seizure of surplus, unused or misused property.

In the decision on the seizure of property that is under the right of economic management, the local executive body (an executive body financed from the local budget, authorized to manage regional communal property) sets the terms for the Company to maintain and ensure the safety of the seized property until it is transferred to another person.
The enterprise is entitled, with the written consent of the local executive body upon the recommendation of the Management Body, to create branches, representative offices, as well as to manage accounts receivable, issue a guarantee or guarantee for the obligations of third parties, and provide loans.
The company independently disposes of non-fixed assets movable property assigned to it on the basis of economic management.
Money received from property transactions specified in paragraphs 75.76 of Section 14 of these Articles of Association is used by the Enterprise on its own, unless otherwise provided by the Budget Code of the Republic of Kazakhstan or by the owner.
An enterprise has the right to alienate property or otherwise dispose of property related to fixed assets assigned to it, transfer and write off receivables only with the written consent of the local executive body, with the exception of cases provided for by this Charter.
The enterprise has the right in the established order to appeal to the court the illegal actions of state bodies, including the actions of the authorized body related to the seizure of the company’s profits, the redistribution of property, placing government orders, setting prices for goods (works, services) produced by the enterprise, as well as other actions that Enterprise rights are violated.

  1. Financing of the Enterprisе

The activities of the Enterprise are financed in accordance with its development plan at the expense of its own income and budgetary funds received in the manner determined by the budget legislation of the Republic of Kazakhstan and its own income.
The procedure for the development and approval of development plans of the Enterprise is determined by the legislation of the Republic of Kazakhstan.

Regulatory deductions of a part of the Company’s net income are established by the local executive body.
Part of the net income of the Enterprise in accordance with the established standards is subject to transfer to the appropriate budget in the manner established by the Budget Code of the Republic of Kazakhstan.

The company transfers part of the net income to the appropriate budget no later than ten business days after the deadline for submitting a corporate income tax return.

The receipt of income necessary for the maintenance and development of the Enterprise, through the execution of state orders, paid services and business contracts concluded with enterprises, organizations, joint-stock companies, partnerships, individual entrepreneurs and individuals.
Organization of the procurement of goods, works and services in accordance with the legislation of the Republic of Kazakhstan on public procurement;
The company independently sells its products.
The prices of goods (work, services) produced by the Company should ensure full reimbursement of the costs incurred by the Company for their production, break-even of its activities and financing from its own income.
Prices for goods (work, services) produced within the framework of volumes (services), financed from the budget, are set by the Enterprise in agreement with the management body.

Income received by the Company from carrying out activities prohibited by the legislation of the Republic of Kazakhstan, not provided for by the Charter, as well as income received as a result of overstating the established prices for goods (works, services) sold, created from financing from the budget, shall be withdrawn to the budget in the manner determined by the legislation of the Republic of Kazakhstan. In case of revealing the facts of using the property without corresponding reflection according to the accounting rules, it is also subject to seizure.
Registered Capital
The size of the authorized capital of the Company is 26,232.4 (twenty-six million two hundred thirty-two thousand four hundred) tenge, which at the time of state registration of the Company was formed by the founder.
Accounting and Reporting
Accounting and preparation of the financial statements of the Enterprise is carried out in accordance with the legislation on accounting and financial reporting of the Republic of Kazakhstan and accounting policies approved by the head of the Enterprise in agreement with the Management Body in accordance with international financial reporting standards.
The annual financial statements of the Enterprise include: balance sheet, income statement, statement of cash flows, statement of changes in equity, explanatory note.
An entity with a supervisory board is required to audit the annual financial statements. The audit of the Enterprise may be carried out on the initiative of the Supervisory Board, Head, Management Body at the expense of the Enterprise.
Responsibility of the Enterprise
An enterprise, under the right of economic management, is liable for its obligations with all property belonging to it.
Relations with the workforce
The relationship between the enterprise administration and the labor collective is determined in accordance with the Labor legislation of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan “On Education” and the collective agreement.
The operating mode of the Enterprise is established by the internal labor regulations and must not contradict the norms of the labor legislation of the Republic of Kazakhstan.
Remuneration of the employee of the Enterprise
The size of the enterprise wage fund is annually established by the Management Body.
The company independently determines the forms of remuneration, staffing, the size of official salaries, the bonus system and other remuneration within the established payroll fund.
Reorganization and liquidation of the enterprise
Reorganization and liquidation of the Enterprise is carried out by decision of the local executive body.
An enterprise may also be liquidated on other grounds provided for by the civil legislation of the Republic of Kazakhstan.

The reorganization and liquidation of the Enterprise is carried out by the Management Body.
The property of the liquidated enterprise remaining after the satisfaction of loans is redistributed by the local executive body.
The money of the liquidated Company, including funds received as a result of the sale of the property of the Company, remaining after satisfying the requirements of creditors, shall be credited to the income of the corresponding budget.
Procedure for making changes and additions
to the charter

Changes and additions to the Charter of the Enterprise are made by the local executive body or an authorized executive body, financed from the local budget, authorized to dispose of the regional communal property.
